UPSEU WINS ANOTHER ARBITRATION CASE FOR CITY OF SPRINGFIELD
After an investigative hearing by the City of Springfield led to the wrongful termination of a UPSEU member with a twenty two year unblemished record, arbitration was filed. The member had union representation and legal counsel retained by UPSEU throughout the entire process. Attorney John Conner from the law firm Connor, Morneau, and Olin led the fight. The arbitration hearings took place on June 7, 2013 and August 21, 2013.
Through its research the Union uncovered the fact that another employee of the City had a similar situation and only received a written warning, while in this case the employee was fired. When the union pressed this issue, the City replied that the employee was terminated. The union supplied information that the employee was not only still employed by the City, but was also a current UPSEU member. The City then recanted its claim of the employee being terminated for the past situation.
Nine people testified during this procedure including expert witnesses in particular fields. The case took a lot of hard work by many people doing research and supplying information. Attorney Connor skillfully presented this information to ensure a strong case.
The arbitrator wrote the decision on December 3, 2013 in favor of the union, reinstating the employee to their former position and being made whole for lost compensation and other rights.
Although nothing can make up for the pain and suffering one goes through when you are terminated, it is nice to know that you have a support team that is experienced and cares about the individual involved. Thanks to all who participated in making this case a success.
